In Clippers court case, octogenarian lawyer relishes the ruckus

By Eric Kelsey LOS ANGELES (Reuters) - With the $2-billion sale of pro basketball's Los Angeles Clippers at stake and the team's irascible owner refusing to bless the record deal his estranged wife brokered, Bert Fields can hardly keep a smile from his face. As one of the colorful cast of characters in a trial over the minutiae of a family trust and California probate law, the 85-year-old attorney to some of Hollywood's biggest players over the last five decades appears to relish his role as the adversary of Donald Sterling, the man banned for life by the NBA over racist remarks. "Bert Fields is one of those lawyers who is in his element in the courtroom," said Steven Weisburd, a Texas civil litigator who has been part of legal teams that have opposed Fields. Fields, who has a reputation for making a witness' time on the stand miserable, may get another shot to examine Sterling as the 80-year-old real estate billionaire could testify again when his own attorneys start their case in Los Angeles Superior Court on Monday.

California law limits school football practices to cut concussions
By Sharon Bernstein SACRAMENTO Calif. (Reuters) - Football practices at which middle- and high-school students tackle each other will be restricted in California under a law signed on Monday by Democratic Governor Jerry Brown, the latest U.S. effort to minimize brain injuries from the popular sport. The measure, which limits practices with full-on tackling during the playing season and prohibits them during most of the off-season, comes amid growing concern nationwide over brain damage that can result from concussions among student as well as professional athletes. "This is a very balanced approach," said Democratic Assemblyman Ken Cooley, the law's author. It's good for kids and it's good for parents." The measure, which goes into effect in January, makes California the 20th state to restrict practices by middle school and high school football teams during which tackling and other full-contact activities are allowed.

Seven ex-NFL players appeal concussion settlement
(Reuters) - Seven retired National Football League players are appealing a recent settlement between the league and about 5,000 former players stemming from a lawsuit over concussions suffered on the field, court records show. The appeal, filed in the 3rd U.S. Circuit Court of Appeals on Monday, came about two weeks after U.S. District Judge Anita Brody granted preliminary approval to a settlement that removed a $675 million cap on awards to former players who were part of the groundbreaking head injury lawsuit. Attorneys for the plaintiffs say 20,000 retired players could be covered under the agreement. The players filing the appeal said the settlement did not offer enough to those who had yet to see the worst of their symptoms appear, and did not cover all diagnoses suffered by players with head trauma.

The Padres agreed to pay $1 million of the remaining $3.968 million on his $10.525 million contract this year. Headley has not reached the production level he achieved two years ago when he hit 31 home runs, led the National League with 115 RBIs in 161 games, finished fifth in the league's Most Valuable Player balloting and won Gold Glove and Silver Slugger awards for the Padres. De Paula, 23, was 6-5 with a 4.15 ERA in 20 games, including 17 starts, for Class A Tampa this year.

Giants' Cain and Belt placed on disabled list

(Reuters) - Matt Cain's injury-plagued season took another downturn on Monday when the San Francisco Giants pitcher was placed on the 15-day disabled list with right elbow inflammation, mlb.com reported. Cain, the Giants' highest-paid player with a $20 million salary, has already made two previous appearances on the disabled list this season because of a cut finger and a hamstring injury. The three-time All-Star, who pitched a perfect game against the Houston Astros in June 2012, will be replaced by right-hander Yusmeiro Petit in Tuesday's starting lineup against the Phillies in Philadelphia. In another blow for the Giants, who are tied for first place in the NL West with the Los Angeles Dodgers, the team also announced on Monday that first baseman Brandon Belt has been put on the seven-day disabled list with a concussion.

Exclusive: Sterling needs $2 bln sale of NBA's Clippers to pay debt

By Eric Kelsey LOS ANGELES (Reuters) - If the disputed $2 billion sale of professional basketball's Los Angeles Clippers is not completed, it could force team owner Donald Sterling to sell off some of his real estate assets to pay back debt, the executive who manages his holdings told a court on Monday. Darren Schield, the chief financial officer of Sterling's Beverly Hills Properties, testified that Sterling's attempts to block the NBA-record sale his estranged wife brokered would open the door for banks to call the real estate billionaire's $480 million in liabilities. "We would have to start selling our real estate," Schield said in Los Angeles Superior Court, adding that Sterling owns about $2.5 billion in property. "We'd have no choice." Schield was called to testify by lawyers for Sterling's wife, Shelly Sterling, who has asked a probate court to confirm her as having the authority to sell the Clippers to former Microsoft chief executive Steve Ballmer.

L.A. Clippers would lose players if Sterling stays: CEO

By Eric Kelsey LOS ANGELES (Reuters) - The Los Angeles Clippers could face an exodus of players, sponsors, fans and their coach if embattled owner Donald Sterling is still associated with the team, Richard Parsons, the franchise's interim chief executive, said on Tuesday at a trial over the NBA team's $2 billion sale. Parsons, the former Time Warner CEO who was installed by the NBA to run the Clippers in May, testified that the team would likely lose profitability and its overall value if sponsors, one of its top revenue streams, leave because of Sterling. "We have a bunch of sponsors who are sitting at the edge of the pool and they don't want to go into the water," Parsons told Los Angeles Superior Court a day after failed settlement talks between Sterling, 80, and former Microsoft CEO Steve Ballmer, who won the bidding for the team.

Judge sets January start for murder trial of ex-NFLer Hernandez

By Elizabeth Barber BOSTON (Reuters) - Former New England Patriots player Aaron Hernandez will be tried in January for the murder of semi-professional football player Odin Lloyd last summer, a Massachusetts judge ruled on Tuesday. Superior Court Judge Susan Garsh ruled at a hearing in Fall River District Court that the former NFL star's trial would begin on Jan. 9, according to a spokeswoman for Bristol County Superior Court. Hernandez has pleaded not guilty to first-degree murder in the shooting death of Lloyd, whose body was found near Hernandez’s home in North Attleborough in June 2013. Garsh did not rule on Tuesday on a motion filed a day earlier by Hernandez's lawyers that asks the court to "take prompt action" to prevent news broadcasts of Hernandez's hearings from capturing courtroom conversations between the former Patriots player and his lawyers.

AJI Report #19 | Scott K Davis and his son Tommy on Gamification and Programming for Kids

Originally posted on: http://geekswithblogs.net/jjulian/archive/2012/11/13/aji-report-19--scott-k-davis-and-his-son.aspx

We are very excited about this show. John and Jeff sat down with Scott Davis and his son Tommy to talk about Gamification and Programming for Kids. Tommy is nine years old and the Iowa Code Camp was his second time presenting. Scott and Tommy introduce a package called Scratch that was developed by MIT to teach kids about logic and interacting with programming using sprites. Tommy's favorite experience with programming right now is Lego Mindstorms because of the interaction with the Legos and the development. Most adults when they get started with development also got started with interacting more with the physical machines. The next generation is given amazing tools, but the tools tend to be sealed and the physical interaction is not there. With some of these alternative hobby platforms like Legos, Arduino, and .NET Micro Framework, kids can write some amazing application and see their code work with physical movement and interaction with devices and sensors.

In the second half of this podcast, Scott talks about how companies can us Gamification to prompt employees to interact with software and processes in the organization. We see gamification throughout the consumer space and you need to do is open up the majority of the apps on our phones or tablets and there is some interaction point to give the user a reward for using the tool. Scott gets into his product Qonqr which is described as the board game Risk and Foursquare together. Scott gets into the different mindsets of gamers (Bartle Index) and how you can use these mindsets to get the most out of your team through gamification techniques.

Originally posted on: http://geekswithblogs.net/jjulian/archive/2012/11/02/aji-report-14-ndash-brian-lagunas-on-xaml-and-windows.aspx

We sat down with Brian at the Iowa Code Camp to talk about his sessions, WPF, Application Design, and what Infragistics has to offer developers. Infragistics is a huge supporter of regional events like Iowa Code Camp and we want to thank them for their support of the Midwest region. Brian is a sharp guy and it was great to meet him and learn more about what makes him tick.

Brian Lagunas is an INETA Community Speaker, co-leader of the Boise .Net Developers User Group (NETDUG), and original author of the Extended WPF Toolkit. He is a multi-recipient of the Microsoft Community Contributor Award and can be found speaking at a variety of user groups and code camps around the nation. Brian currently works at Infragistics as a Product Manager for the award winning NetAdvantage for WPF and Silverlight components. Before geeking out, Brian served his country in the United States Army as an infantryman and later served his local community as a deputy sheriff.

AJI Report #18 | Patrick Delancy On Code Smells and Anti-Patterns

Originally posted on: http://geekswithblogs.net/jjulian/archive/2012/11/09/aji-report-18--patrick-delancy-on-code-smells-and.aspx

Patrick Delancy, the first person we interviewed on the AJI Report, is joining us again for Episode 18. This time around Patrick explains what Code Smells and Anti-patterns are and how developers can learn from these issues in their code. Patrick takes the approach of addressing your code in his presentations instead of pointing fingers at others. We spend a lot of time talking about how to address a developer with bad practices in place that would show up on the radar as a Code Smell or Anti-Pattern without making them feel inferior. Patrick also list out a few open-source frameworks that use good patterns and practices as well as how he continues his education through interacting with other developers.
